Federal Judge Orders Freedom of Kilmar Abrego Garcia from ICE Detention
A federal judge has ruled the prompt release of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing detainment is without lawful basis.
"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her order.
The situation originates in a erroneous deportation to El Salvador in March, which US authorities later admitted was an mistake. After his return to the United States to face human smuggling charges, he was detained in immigration detention.
In her order, the judge pointed out that the government does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "for now."
Background of the Legal Challenge
The court proceedings involve conflicting claims. While the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this allegation.
He has also pleaded not guilty to the conspiracy charges, which are part of a separate trial in Tennessee.
Conditions of Freedom
The court, who was overseeing his challenge to removal in a federal court, determined that he must now comply with the conditions of his bond from jail in Tennessee. This order effectively transfers his supervision to the jurisdiction handling his criminal case.
This ruling marks a significant development in a complex immigration case featuring allegations of mistaken imprisonment and disputed criminal affiliations.
